Land plot cadastral number not needed for house sale and purchase

Pursuant to ‘Delo’ journal, The Decree No. 749 adopted by the Cabinet of Ministers of Ukraine on 18 August 2010, previously worked out and submitted for CMU consideration by the State Committee of Ukraine on Land Resources (Derzhkomzem), approved the Temporary procedure of cadastral numbers assignment to a land plot.

As informed by the press office of Derzhkomzem, the Temporary procedure comes into force simultaneously with the Decree No.1021 issued by the CMU on 09 September 2009 ‘On the approval of the procedure of keeping the Land records and the Book of entries of state registration of state acts on ownership right to a land plot and right to a land plot permanent use, land lease agreements’.

The Temporary procedure defines the procedure of land cadastral numbers assignment to the land plot and relevant data entry to the State Land Registry.

Cadastral number isnt needed any more  

Now the land plot cadastral number isn’t obligatory when selling and purchasing the house located on the plot.

Pursuant to the current legislation in force, cadastral number of a land plot, on which the real property to be sold and purchased is located, is obligatory for conclusion of a relevant sale and purchase agreement with regard to a residential house, building or facility.

The effectiveness of the said normative act will correct the legislative preclusions which arose when concluding real estate sale and purchase agreements.

Is the Temporary procedure going to facilitate cadastral numbers assignment?

Moreover, adoption of the Temporary procedure of cadastral numbers assignment to a land plot will introduce the legislative regulation of the procedure for cadastral numbers assignment to land plots, will provide the identification of each land plot, and will facilitate the efficiency of the control over land distribution.

‘The document will ensure the land legislation observance with regard to the state land cadastre keeping and facilitate the protection of constitutional rights of Ukrainian citizens to land’ – said Oleg Kulinich, a Chairman with Derzhkomzem.

As a reminder, the effectiveness of the Order No.168 ‘On approval of the procedure of land cadastral numbers assignment’ issued by Derzhkomzem on 15 February 2010 was cancelled pursuant to the Letter of Alexander Lavrinovich, a Minister of Justice. The Decree ‘On approval of the Temporary procedure of cadastral number assignment to a land plot’ was worked out by the Derzhkomzem specialists and submitted to the Cabinet of Minister of Ukraine for further approval.
